Bonito Designs – Offer Terms & Conditions (GST Waiver Program)
These Terms & Conditions (“T&C”) govern the applicability of the “GST Waiver” promotional offer (“Offer”) extended by Bonito Designs Pvt. Ltd. (“Bonito”). By availing this Offer, the customer agrees to be bound by the terms set forth below.
1. Nature of Offer
The Offer is a promotional pricing construct marketed as a “GST Waiver.” This terminology is used solely for promotional and marketing purposes and does not imply, represent, or constitute an exemption, reduction, or non-applicability of Goods and Services Tax (“GST”) under applicable law.
2. Compliance with Taxation Laws
Bonito remains fully compliant with all applicable taxation laws, including but not limited to the Central Goods and Services Tax Act and related regulations. GST shall be levied, charged, and collected on all invoices in accordance with prevailing statutory requirements.
3. Pricing Mechanism
The Offer operates through a structured adjustment in the base price of products and/or services. The revised consideration payable by the customer is determined such that the final invoice value, inclusive of applicable GST, aligns with the promotional construct communicated under the Offer.
4. Applicability on Additional Commercial Adjustments
Any subsequent commercial arrangements, including but not limited to negotiated discounts, cashback schemes, referral benefits, or delay compensations, shall be treated independently of the Offer and will be subject to applicable GST implications as per prevailing laws.
5. Invoicing and Financial Treatment
Notwithstanding the promotional nature of the Offer, all financial documentation, including invoices, receipts, and related records, shall explicitly reflect GST as a separate line item in accordance with statutory invoicing requirements.
6. Customer Support and Clarifications
Customers may seek further clarification regarding financial computations, invoicing structures, and tax implications by reaching out to Bonito’s customer support team via the official “WeCare” channel.
7. B2B Transactions
For business-to-business (B2B) transactions, the GST component reflected in invoices shall be governed strictly by applicable input tax credit rules and statutory provisions. The financial impact of the Offer may differ from standard consumer transactions and shall not be construed as equivalent to a waiver of GST in such cases.
8. Eligibility and Discretion
The Offer is extended at the sole discretion of Bonito and may be made available selectively to customers, projects, geographies, or time periods as deemed appropriate by Bonito.
9. Non-Negotiability
The Offer is provided on a strictly “as-is” basis. Customers may choose to accept or decline the Offer in its entirety. Partial modifications, substitutions, or negotiations on the structure of the Offer shall not be permitted.
10. Right of Refusal
Bonito reserves the right to determine customer eligibility and retains full discretion to refuse, withdraw, or discontinue the Offer for any customer or project at any stage, without prior notice or obligation to provide justification.
11. General Rights
Bonito reserves the right to amend, modify, suspend, or withdraw the Offer and/or these Terms & Conditions at any time without prior notice. In case of any dispute, Bonito’s decision shall be final and binding.
